Terms & Conditions

These terms ("Terms") govern your use of the WayWaker app ("WayWaker", "the app"), provided by shaunniekins ("we", "us"). By downloading or using WayWaker, you agree to these Terms. If you don't agree, don't use the app.

1. What WayWaker does

WayWaker lets you set alarms on places. It watches your device's location and alerts you when you enter or leave an area you chose, and can text your chosen contacts when an alarm rings.

2. Reliability and safety

Location alarms depend on things outside our control: GPS accuracy and signal, your device's battery and power-saving settings, permissions, the operating system stopping background apps, your volume and Do Not Disturb settings, and your mobile network. As a result:

• an alarm may ring early, late, or not at all;
• the Text ETA option may not appear if the alarm doesn't ring, and a message you send may be delayed or not delivered.

WayWaker is a convenience, not a safety device. Don't use it as your only way to wake up or to reach a stop when missing it could cause harm, and don't use it for emergencies. Keep your eyes on the road: set up alarms before you drive, and follow local laws on phone use while driving.

3. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use WayWaker on devices you own or control, in line with these Terms and the rules of the store you got it from (Google Play or the App Store).

4. Acceptable use

You agree not to:

• use ETA messages to send spam, or to text people who haven't agreed to hear from you;
• use the app to track, monitor or follow anyone without their consent;
• copy, modify, distribute, sell or lease the app, or reverse engineer it, except as the law expressly allows;
• use the app in a way that breaks the law or the terms of the store you got it from.

5. Text messages

WayWaker doesn't send text messages itself. "Text ETA" opens your messaging app with a message filled in; if you send it, it goes from your phone number through your mobile carrier, and you're responsible for any charges. You're responsible for the content of your message template and for having permission to text the contacts you choose.

6. Maps and third-party services

Map data is © OpenStreetMap contributors, available under the Open Database License. Maps and place search are provided by third parties under their own terms, and may be inaccurate, out of date or unavailable. We aren't responsible for third-party services.

7. Free features and Premium

WayWaker is free to use within its limits (currently 3 alarms on at once; downloading map areas for offline use is planned for Premium). We may offer a paid Premium plan in the future. If we do, its price and terms will be shown before you buy, and payments will be handled by Google Play or the App Store under their terms. Features you can use for free today will stay free.

8. Intellectual property

WayWaker, its name, logo and design belong to shaunniekins. These Terms don't give you any rights to them beyond the license in section 3.

10. Disclaimer

WayWaker is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the app will be free of errors, always available, or that any alarm or message will work as expected.

11. Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or inability to use, the app, including missed stops, missed appointments, travel costs or carrier charges. Where liability can't be excluded, it is limited to the amount you paid for the app, if any. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

12. Changes and termination

We may update the app or these Terms. When the Terms change, we'll update the effective date above. Continuing to use the app after a change means you accept the new Terms. You can stop using WayWaker at any time by uninstalling it. Your license ends automatically if you break these Terms.

13. App Store terms

If you got WayWaker from Apple's App Store, these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, and is a third-party beneficiary of these Terms with the right to enforce them against you. Apple's Licensed Application End User License Agreement applies where it gives you more rights.

14. Governing law

These Terms are governed by the laws of the Philippines, without regard to its conflict-of-law rules.
